Our client was arrested in Italy following a Pakistani international arrest warrant. The extradition proceedings were conducted before the Turin Court of Appeal. We challenged the request on multiple grounds and secured our client's release from custody pending the conclusion of the proceedings.
Pakistan submitted an extradition request through the formal diplomatic channels, supported by documentary evidence transmitted through the Italian Ministry of Justice. Our client was arrested in Italy on the strength of this request. The allegations related to serious criminal conduct allegedly committed in Pakistan. Our client strongly denied the allegations and contested the fairness of the Pakistani legal process.
We developed a defence focused on three axes: the inadequacy of the evidentiary documentation submitted by Pakistan; the failure of the request to satisfy the formal requirements under the bilateral extradition treaty between Italy and Pakistan; and the documented risk that our client — given his political and ethnic profile — would face treatment in Pakistani custody contrary to Article 3 ECHR. The Court of Appeal found sufficient merit in our arguments to release our client pending full consideration of the request.
