Our client, a foreign national long resident in Italy, was arrested following a Peruvian international arrest warrant transmitted through Interpol. Despite the gravity of the allegations, we obtained his release from custody and challenged the legal basis for his potential extradition.
Our client was arrested at his home in Italy following an Interpol circolar issued at the request of Peruvian authorities in relation to serious criminal charges. He was brought before the Italian Court of Appeal for the validation of the arrest and the commencement of the extradition procedure. He had been resident in Italy for many years with his entire family.
We presented an immediate application for release on the grounds that the conditions for the application of custodial measures in the context of extradition proceedings were not met. We challenged the gravity of the factual basis of the Peruvian allegations, the reliability of the documentation provided, and the conditions of detention that would apply if our client were extradited. The Court of Appeal accepted our application and released the client.
Arrest on an international warrant does not mean extradition is inevitable. Italian law gives the Court of Appeal broad discretion in extradition proceedings, and we exercise every available argument to protect our client's rights at each stage.
Our client was released from custody. The extradition proceedings are continuing, but our client remains free in Italy while the case is argued before the Court of Appeal. We are pursuing all available defences to block extradition.
